These Terms of Service ("Terms") govern your use of the Aether Intelligence platform, including our websites at aetherlabs.live and app.aetherlabs.live, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Important: Aether Intelligence is an educational platform, NOT a registered investment advisor (RIA). We do not provide financial advice. All investment decisions are yours and yours alone. Past performance does not guarantee future results. Investing involves risk, including the possible loss of principal.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old to use the Service.

2. Description of Service

Aether Intelligence provides:

Educational market research tools and data visualization
Portfolio aggregation across connected brokerage accounts
AI-powered analysis and insights (via "Claudia")
The ability to execute trades through your own brokerage accounts

Non-Custodial: We never hold your funds. Your assets remain in your brokerage accounts. We connect to your accounts through secure third-party services (SnapTrade) using industry-standard OAuth authentication.

3. Not Financial Advice

The Service is for educational and informational purposes only. Content provided through the Service, including AI-generated analysis, signals, data, and research:

Does NOT constitute investment advice, financial advice, trading advice, or any other advice
Does NOT constitute a recommendation to buy, sell, or hold any security
Should NOT be relied upon for making investment decisions
Is NOT a substitute for professional financial advice

You are solely responsible for evaluating the merits and risks of any investment decision. We strongly recommend consulting with a qualified financial advisor before making investment decisions.

4. User Responsibilities

You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Use the Service only for lawful purposes
Not attempt to reverse engineer, hack, or disrupt the Service
Not use the Service to manipulate markets or engage in illegal trading
Take full responsibility for all trading decisions and their consequences

5. Trade Execution

When you execute trades through the Service:

You are instructing your broker to execute the trade on your behalf
All trades are executed through your connected brokerage account
You must review and confirm each trade before execution
We are not responsible for trade execution, timing, fills, or prices
Your broker's terms of service govern the actual trade execution

We do not guarantee that any trade will be executed, executed at a particular price, or executed in a timely manner. Technical issues may prevent trades from being submitted or executed.

6. Data and Accuracy

While we strive to provide accurate information:

Market data may be delayed or inaccurate
Portfolio data depends on third-party providers
AI-generated content may contain errors
Historical data does not predict future performance

You should independently verify all information before making decisions. We are not liable for any losses resulting from data inaccuracies.

7. Third-Party Services

The Service integrates with third-party services including:

SnapTrade for brokerage account connectivity
Anthropic for AI capabilities
Various market data providers

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

8. Intellectual Property

The Service and its content, including software, design, text, and graphics, are owned by Aether Intelligence LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR COMPLETENESS OF INFORMATION
UNINTERRUPTED OR ERROR-FREE OPERATION

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AETHER INTELLIGENCE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, or goodwill
Any investment losses or trading losses
Any damages arising from your reliance on the Service
Any damages resulting from unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aether Intelligence LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your investment decisions
Your violation of any third party's rights

12. Account Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may also delete your account at any time. Upon termination, your right to use the Service ceases immediately.

13. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time. We may also modify these Terms. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Wyoming. You waive any objections to jurisdiction or venue in such courts.

15. Arbitration Agreement

You agree that any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association, rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aether Intelligence LLC regarding the Service.
